NAWAB DIN versus PROVINCE OF PUNJAB THROUGH COLLECTOR
The referee court determined the extension of compensation of Rs 75,000 per kNal to increase the Section 23 compensation, which rejected the claim of the appellant for raising the Rs.3,00,000 per kanal. At the time of the award collector's announcement, the land had a canal acquisition of Rs.300,000 which was not available to show the market value of the land after considering all the relevant factors giving such reasons. The rate was fixed, which the appellant failed to prove to be insufficiently high. The court retained the same award in other appeals which was challenged by other landowners. Appellant's land was similar to that of other landowners. The High Court dismissed the appeal, seeking to uphold the same award in the case of the appellant. \ r \ n
