HASSAN ABBAS versus IST ADDITIONAL DISTRICT AND SESSIONS JUDGE
A VII, R 11 West Pakistan (Board of Intermediate and Secondary Education Karachi) Ordinance (III of 1962), Sections 27 and 29 of the Special Relief Act (I of 1877), Section 42, dismisses the plaintiff for correction of the father's name Was asked to. The plaintiff's name was erroneously mentioned in the school record by the plaintiff's father and was also disclosed by his mother's affidavit, which was filed by the Education Board. The source maintained was invalid and the plaintiff's father could not be his mother and the same trial court was obliged to reconcile on the record of the Education Board that the Board of Education with the plaintiff's father's correct name in view of the available records. The plaintiffs had no objection to the request made by the plaintiff. The appropriate application in which the comparisons and conditions are mentioned was brought to the notice of the Board of Education but was denied without assignment. The Prevention of Corrections in Record Section 27 of the Secondary Education Ordinance, 1962, did not mean that the Board of Education was a final authority and passed by it. The courts did not, under section 29 of the Board of Intermediate and Secondary Education Ordinance, 1962, review that there should be no lawsuit against any member of the Government and the Board of Education or any other legal action. The Board of Education was not challenged, nor did the plaintiff in the present suit file any damages against the controlling authority or member of the Board of Education.
