ALLAH KHAN versus AMIR MUHAMMAD KHAN
The accused for the cancellation of Section 497 (5) Contempt Rule (XLV of 1860), Sections 302 and 324/34 were charged with the role of Lalakar, while other accused persons were found to be ineffective on the complainant and the witnesses. The role of the firing was declared. The release of the accused on bail by the trial court was in accordance with the rules established to approve the bail. Once a person has been released on bail, he has to establish strong grounds for cancellation, which in the present case is non-binding. After release on bail, the accused were intimidating and thus misusing the bail exemption, but no evidence was appearing in this regard. If such situation arises then the complainant will be allowed to cancel the bail. There will be freedom to move from end to end. The request for cancellation of bail was dropped by the accused under section 497 (5) CRPC petitions.
