GHULAM QADIR versus GOVERNOR OF BALOCHISTAN THROUGH PERSONAL SECRETARY, QUETTA
The scope of section 9 (1) (2) of the Balochistan Service Tribunal Act (v. 1974), Article 412 of Pakistan, Arts 199 and 212 of the Constitution Civil Service Bar contained in Article 1212 of the Constitution appeals to the applicant as senior science. The teacher was appointed. (General :) (SST) in BPS 16 but they were terminated against whom they filed representation which was not decided, they lodged a complaint before the provincial Ombudsman The provincial ombudsman was declared ruler and separated by the governor. The applicant filed after a nine-year delay, which the Ombudsman ordered him to be dismissed before the Ombudsman as a public servant of the applicant without making any request for contempt of respect or of respectable purpose, which had the terms and conditions There was no jurisdiction over matters. Terms of Service Complaint filed by the applicant before the Ombudsman was not sustained and the order was passed without any jurisdiction and legal authority. In the context of the terms and conditions of service of a civil servant, the dispute can be raised only before a proper service tribunal and not before it. The Ombudsman Petitioner was a public servant at the end of his term of employment and was obliged to resolve his complaint with the service tribunal. The constitutional application was dismissed under the circumstances.
