The accused and the documentary evidence were already obtained by the investigating officer, which was part of the reference filed against the applicant, therefore, sending the applicant behind the bars would not prove to be a worthwhile purpose if the beneficiaries were already guaranteed. Before the arrest was recognized, the applicants who were present in favor of exceptional circumstances were brought under Section 497 (2), CR PC, the benefit of which was to be extended in their favor, therefore, every arrest was made.
