The respondent was a Stenographer Grade II in Revenue, Muhammad Yaqoob Shah and Bashir Ahmad are in the Executive Department. The dispute is about the maintenance of separate seniority lists or making joint seniority list of both the department. If joint seniority list is to prevail then the respondent having come in service before Muhammad Yaqoob Shah and Bashir is senior to them. On the basis of treating the two depart ments as separate from each other Muhammad Yaqoob Shah and Bashir were promoted to Grade I Stenographer and the respondent was ignored.

There was no scope for stenographers working in the Revenue Wing for promotion. The Chief Engineer, Faisalabad, therefore, made recommenda tion for amalagation of Revenue Staff with the Executive Staff vide letter R. 2. On the other hand, the Assistant Chief Accountant vide his letter R. 4 informed the Managing Director (P) WAPDA Lahore that separate seniority list of Revenue Staff was being maintained and said that Staff of Revenue Offices will be borne separate cadre on Regional basis and will not be amalgamated with the ministerial staff of the executive offices. Confirmation of proposal was sought for but this is not known that what orders were passed as no order of confirmation has been brought on the record. However, connected seniority list R. 3 has been produced which is evident of the fact that the service of Stenographer of Revenue Wing and Executive Wing have been amalagmated. If R. 3 had been the best of one category namely the name of the Stenographer of other category would have not been found in R. 3. This list shows that the respondent is senior to Yakoob Shah and Muhammad Bashir. Name of Bashir Ahmad is below the name of the respondent. The name of Yakoob Shah does not figure in the list of Stenographer Grade II as he had been promoted to, Grade I. His name figure in the list of Grade I Stenographer but his date of appointment is 12th September, 1969 whereas the date of appointment of the respondent is 1st May, 1967.

It stands established that the respondent was recommended for pro motion meaning that there was no other hurdle in his way and he was found fit for promotion. The direction of the learned lower Court for his promotion therefore is correct.

There is no force in the appeal which is dismissed.
