Prior to the arrest of Section 498 Defamation Code (XLV of 1860), Section 489F arrest, the bank had disregarded the check of Rs.400,000 given to the complainant by the accused before the Sessions Court. Three requests for arrest warrant were filed, two in his third plea that the accused suppressed the fact of his earlier dismissal of two petitions, before the accused was convicted on police charges. The High Court dismissed the prosecution while the order was in place. The current bail plea was recorded by the High Court. Absolutely neglected by the court, the extraordinary exception may be allowed in extraordinary circumstances, as appears in part for Malala's corrupt or unlawful purpose. The complainant or the police, which was not prosecuted in the instant bail plea, was charged with disorderly conduct contrary to the accused. Counsel for the accused also failed to uphold his responsibilities in requesting court bail.
