MUHAMMAD ASHRAF ALIAS KALI versus STATE

The suspects were not named in the FIR as defined in the evidence appearing at Section 302 of the Anti-Terrorism Act (XXVII of 1997), Section 7 (a) on the night of the dark, there was no linking of the accused to the commission of the crime. Direct evidence was not available. The evidence of extra-judicial confession against the accused on record was not substantiated by any witness, nor could it be the basis of his conviction on a major capital charge, nor did the complainant nor any other witness. Recovery of weapons identified from the police was not sent to the forensic science laboratory against crime protected by the police as no special injury was attributed to the accused. The suspects were acquitted.
