The plaintiff's view on behalf of the plaintiff was that after deducting the amount of land sold to the defamatory society, the outstanding amount was Rs. 36 lakhs while the plaintiff paid 2% liquidation charges, with a payment of ???? 61 lakh for the release of his land. The plaintiff was entitled to recover from the board after the deduction of Rs 36 lakh. Which was in equilibrium with the society and furthermore that the plaintiff could not be accused of being charged because the plaintiff was not at fault in completing the matter and he was also not a lender. The valid contract of sale could not be completed. Defunct Society was not guilty of failing to complete the sale deed because the sale and purchase was banned from the Society or the plaintiff was responsible for paying the remaining amount to the plaintiff society
