ISHRAT JEHAN versus PROVINCE OF PUNJAB THROUGH SECRETARY HOUSING, PHYSICAL AND ENVIRONMENTAL PLANNING DEPARTMENT, LAHORE

Section 11 Constitution of Pakistan (1973), Article 199 Constitutional Application Plot provides for an exemption in favor of the applicant in lieu of land compensation. On the basis of the decision of the District Housing Committee, the cancellation of such plot has been denied by the petitioner filed by the Attorney General. The applicant has made such application or appointed a general counsel or received compensation for the land acquired. The allegations of accuracy were not available on the plea and generally on record, thus, in the absence of any reasonable action by such a committee. On the basis of any material document, the High Court reversed the proceedings of such committee and directed the defendant to take possession of such plot subject to payment of development and other compensation to the applicant.
