The Para 11 candidates from the NWFP passed the C-Section Competitive Examination, losing their first choice to the Department in 2003, on the basis that the C-Section Competitive Examination, for another candidate appearing in 2001. The seat was already used and they were domiciled. The court was ordered by the NWFP to use the seat and the Public Service Commission had never requested the Establishment Division nor advised that it should already appoint a NWFP quota for the department as C Section Section Competitive Examination for the year 2003 / Deduction, which did not follow any law, rules or any departmental instruction or order, had the effect of depriving a candidate of a seat that would otherwise Pass, the procedure adopted by the authorities was against the law.
