The case was referred to the High Court by the civil court so that the matter could be transferred to a competent court instead of presenting it in the appropriate forum. The Valdetti Civil Court found that the dispute between the parties had to be exclusively heard and decided. Through the Special Banking Court, he should have directed the return of the plaintiff's case for presentation to the special court without making any reference to the High Court under Article 203 of the Constitution. The matter should be returned to the civil court with further instructions to return the plaintiff to the plaintiff before the competent court for its motion and accordingly dispute it.
