NAZIMUDDIN versus S.M.E. LEASING LIMITED

Sections 5 and 9 of the Civil Procedure Code (v. 1908), section 24, apply to the plaintiff to transfer the plaintiff's case from the banking court to the real banking jurisdiction of the High Court in which the plaintiff is suing. It will be beneficial to justice and to the interest of both parties as the joint trial will certainly eliminate the possibility of conflicting decisions.
