AAMIR HAMEED versus ADDITIONAL DISTRICT JUDGE, FAISALABAD

Section 15 Constitution of Pakistan (1973), Article 199 Constitutional application for dismissal of tenant entered into but the petition for leave to defend the trial court did not. The appeal was accepted by the tenant and the case was remanded in trial court. It was ordered a hearing and a pre-emption proceeding. The tenant applied to keep the former party proceeding separate but did not file a leave for defense; consequently, the rental tribunal ordered the tenant's removal. The given tenant's appeal was dismissed when the appellate court joined the proceedings before the rental tribunal by law, while the appellant was instructed by law and paid the rent to the tenant.
