Two accused have been convicted under Section 395 and 71 West Pakistan Arms Ordinance (XX of 1965), Section 13E Criminal Procedure Code (V9 1898), Section 3595 PPC and Section 13E of the West Pakistan Arms Ordinance, 1965. Allowed, to operate permanently, as directed by the trial court, would exceed the maximum sentence allowed under Section 13E of the West Pakistan Arms Ordinance, 1965, which covers sections 35, CRPC and 71P. There will be a breach of the provisions of the PC which resulted in the order. He presented an unusual situation for the third accused to be sentenced together by the High Court even though it was not more than the maximum sentence imposed, as if his convictions were allowed to run consecutively. When he goes, he carries a longer sentence than the other two accused.
