ASHFAQ GHORI versus IVTH ADDITIONAL DISTRICT JUDGE, KARACHI

Section 15 and 22 constitution of Pakistan, Article 199 Constitutional application to prevent tenant's eviction proceedings filed by the landlord was granted by the rent controller and the appeal against the eviction order was dismissed. The legal prosecutor had filed the appeal for restoration of the appeal, but in the meantime the appeal filed by the landlord tenant was that the withdrawal order could not be processed during the restriction of the appeal for appeal restoration. The tenant was too numerous to discuss the matter or to submit any injunction The opportunities were, but he failed to act on any matter. Such conditions the High Court did not find any merit in the petition as the tenant was only delayed in the matter. The constitutional petition was dismissed in the circumstances.
