SAIFULLAH KHAN versus KARACHI CUSTOMS AGENTS ASSOCIATION

Sections 14, 17 and 30 of the Sindh Chief Court Rules (OS), RR 282 and 283 Award Objector Matters were referred to the sole arbitrator, with the consent of the parties and the arbitrator filing the award as per the court's rule. The defendant objected to the objection on the grounds that he was not given the opportunity to be heard that the plaintiff's defendant had fully participated in the proceedings and specifically mentioned in the objections that his awards were mediated. After allowing the award to be dealt with by the award, the defendant was resigned and was denied. The issue of objecting to the fact that he was either not heard or not given the proper opportunity to present his case was found by the High Court to be objectionable and against the record. ? The right of the High Court was binding force and such award was to be made the rule of the court award and it was made the rule of the court.
