ZAHID HUSSAIN versus STATE

The dismissal of the criminal appeal for Articles 410 and 423 illegal prosecution was denied by the trial court's order, under which their criminal appeal was dismissed for illegal prosecution. And later his request for reinstatement was also rejected, after admitting the criminal appeal, which could not be dismissed without acknowledging his merits. And the absence of the appellant or his counsel was not the basis for dismissal, unless all the questions raised were decided and the facts and legal aspects were crushed under section 423 as contemplated. The RPC did not confirm the trial court's order. The law; and these were against criminal jurisprudence. The High Court said that the orders were kept in accordance with the court and the matter was remanded in the appellate court for the decision to re-appeal the merit.
