He was withdrawn by the Accountant General because his Chief Justice was not certified, so according to the provisions of the Fourth and Fifth Schedule of the Constitution, judges judge the beneficiary as a judge, Chief Justice / Chief Justice / The High Court judges are entitled to the same salaries, allowances, privileges and pensions as are applicable to the Chief Justice and Judges of the Supreme Court and High Court in Pakistan respectively. The Government of Pakistan had approved the appointment of an Acting Chief Justice of Pakistan Pension and Retired through notification 21 21 1999 as the Chief Justice both the applicants had been acting Chief Justice and had received pension benefits as Chief Justice of the Supreme Court. And the High Court had already received and after the execution of the law by the Accountant General, neither the applicants were presented with any reason nor their pension benefits were redetermined. The hearing was held, which was against the orders issued by the Accountant General. High Court sets aside orders not to be made without legal authority, arbitrary and arbitrary writ petitions allowed
