PAKISTAN TELECOMMUNICATION COMPANY LIMITED versus EMPLOYEES\' OLD-AGE BENEFIT INSTITUTION
Payment of funds under Sections 9, 9B and 47 of Pakistan Telecommunication (Reorganization) Act (XVII of 1996), Article 34 Constitution of Pakistan, Article 199 Constitution of Pakistan Telecommunication Company Limited employees of Sections 9 and 9B of such company employees. Denying the Old Age Benefits Act, 1976, accusing yourself of becoming a legal entity, thus, does not fall within the definition of a \ Establishment \ or \ industrial \ concern, as it is not responsible for the payment of such funds. The justification was not the Employment / Old Age Benefits Institution tax, but the purpose was to protect the working class of employees. Such a company was established under the direction of the federal government issued under section 34 of the Pakistan Telecommunications (Reorganization) Act 1996, but was not created by any law, thus it could not be considered. As a legal body; the Company is limited by shares and incorporated under the Companies Ordinance, 1984; it was not a legal entity, and employees will not fall outside the scope of the Old Age Benefit Act 1976, The availability of other benefits to company workers will not exclude the application of the said Act.
