Section 148 Special Relief Act (I of 1877), extension of time for non-payment of section 8 suit appeal court fee for possession of immovable property, was dismissed by the appellate court for non-payment of court fees. ? Appellants believed they were not directed to pay court fees. The validity of the imputed decree was Rs. 6,50,000 and it was appellant's knowledge that the appellant was required to affix a court fee of Rs. 15,000 along with the appeal memo. In his absence, there was a record of imbalance and financial appellant bound to learn about court orders because they had neither paid the court fee on the due date nor had they requested extension. Appellant appeared to have violated the Appeal Directive. The court will pay the court fees despite giving them the opportunity to dismiss the appeal and dismissal was granted. In the circumstances, the review was rejected.
