O XLI, Rr 31 and 32 of the Special Relief Act (I of 1877), the trial court ruled to challenge the validity of the diversion in the appeal, but dismissed it by the appellate court's stand. It was held that the appellate court was bound to record its findings. Under the law, not every issue was individually enforceable as every issue was necessary to discuss, but it was not necessary for the appellate court to record a separate inquiry into each case, like the trial court.
