Section 115 of the Special Relief Act (of 1877), the Appellate Court excluded section 42 suits for declaration. And during the hours of the appeal, the defendant died and his legal heritage was declared a plaintiff, the amendment did not enforce the defendant's legal heritage, and he preferred the revision against the original defendant. The appellate court-ordered restitution order names the plaintiff's legal representatives / heirs and, for that reason, it was well before the plaintiff's institution to know the defendant that the defendant had filed a civil suit against a deceased person.
