MASOOD AHMED ABBASI versus GULAB KHAN
Sections 8 & 8 & 4 454/3434 Criminal Code of Conduct (v. 1898), the appeal against section 417 appellant / complainant's fate was that his guardian, appointed 40 years ago, was allowed to enter the plot. Was not allowed against whom the FIR was lodged, the accused (the watchman) under Sections 8448 and 34 454/3434, proceeded the PPC case by the Magistrate and under Section 249A, CRPC. The accused was acquitted, with the observation that there had been no commitments in the case, the State Counsel also stated that the present appeal was not manageable and the magistrate's order was appropriate. The Plaintiff also did not file any document regarding the fact that the appellant had separated himself from the plot about 40 years before the occupation of the plot, in which case no commitments were made. Appeal dismissed
