Section 115, the Declaration of Special Relief Act (I of 1877), Articles 27, 42 and 12 Amendment suits, the parties have been practicing litigation for almost 37 years (since 1971) and the whole process has been completed. The statement that the respondent's counsel stated that they were without the consent of the respondents, that such a cloud would crush the entire practice of 37 years and then adjourn the matter indefinitely. Hold, therefore, the High Court, with all kinds of justice, directed the parties to avoid such trial and in the interest of justice.
