Sections 10 and 7 the respondent bank dismissed the application for leave to file a lawsuit against the appellants for the recovery of the loan and the bank's claim was denied that the loan in question was subject to assumption of stock. The one that was lost was insured and the bank was the beneficiary of such insurance, therefore, the bank was only entitled to claim from the insurance company and could not approve the forthcoming markup. The appellants failed to show the approved documents that had been admitted. The parties, who will be eliminated in the event of a loss of assumption by the appellants on behalf of the appellants, were at best delusional as there was no dispute over the receipt of the loan amount and this time the issue was not disputed. It was reported that a certain amount had been received otherwise. However, the High Court deemed it appropriate that the appellants be granted leave to defend the case subject to the LL assemblage.
