HAJI KHUDA BUKHSH versus DEPUTY REGISTRAR, COOPERATIVE SOCIETIES, PUNJAB, LAHORE
Article 48 of the R48 Cooperative Society Act (VII of 1925), the Constitution43 Constitution of Pakistan (1973), Article 199 Supervision of the Constitutional Appeal, was rejected by a registrar of a society for a fresh election due to a lack of order. Subsequently, the superstructure built on it had to collapse, the management of the society was abolished by an illegal order, and on the basis of this the election was declared to be a constitutional petition, which led to the new elections. The declaration would be an endorsement of an illegal order that could not have happened. Retention was a long time in the current administration of the society because their term would be reduced by the dismissal of the constitutional petition for holding of employment and the affairs of the society.
