RAJIB versus STATE
Section 497 Crimes against Property (Enforcement Hood) Ordinance (VI of 1979), Section 21 bail, police filed an FIR against the accused, yet no case was registered against him. Based on that, the trial court had filed the case. The suit did not use its gold and the accused's plea to consider his former criminal case was denied. On the bare statement of the trial, the trial court held that the accused did not consider this fact. The criminal record, whether the culprit was convicted or not, was a past conviction. There is no basis for understanding that the accused was also involved in the crime, which on his face did not prove to be a criminal offense, the charges were extended on bail, under the circumstances.
