NAJMUL HASSAN ATA versus HABIB BANK LIMITED THROUGH PRESIDENT
The Appeal Counsel for the Section 2 Appellant acknowledged that the Appellants did not have a case to pursue, but as an Appellant, who died thereafter, it was claimed. It was argued that the case against the deceased appellant was irrelevant as it was not real credit, but some documents were imposed in favor of the bank to secure payment from the other appellants. Counsel for the appellant's counsel was to suggest that the deceased appellant's liability would be limited only to the extent of the liability arising against him by executing the documents. Only to the extent of his obligation can he be executed against the late appellant in view of the documents executed by him.
