UMAR ZAMAN versus MANZOOR HUSSAIN
Section 42 (ii) Amendment Appeal to the High Court Rules (1984) R44 (2) High Court, challenging the validity of the legal status and order passed by the Senior Civil Judge, delayed the High Court. The relevant review request was filed. The request for review was barred by the ban, but in the review note it was appealed by the appellant that the rules were laid down for smooth running of the judicial system and the Code of Conduct of the Azad Jammu and Kashmir High Court. Under Rule 44 (2) of the 1984 Act, a party was ordered to file a revision request within 90 days from the date of the amended application in this case, which is the current period. Filed after termination, sufficient cause was to be given for contempt of delay, but the appellant was not aware of the period due to limitation and In the circumstances, the revocation request was rightly dismissed on the grounds that it did not raise any grounds for a defamation petition.
