AXXI, RR 72, 84, 85 and 86 Constitution of Pakistan (1973), Article 185 (3) Auction sale Auction buyer by illegal order, after auction the sale of the property to the next highest bidder without auction The default buyer, the execution court has declared the applicant to be the next highest bidder to match the bid amount and submit the same as the procedure adopted by the implementing court which was set by the High Court and post-remanded. The execution court had put aside the earlier order and ordered the auction. The petitioner submitted that his favor of auction / sale was beyond the jurisdiction to terminate it after the certiorari had confirmed that the order had been finalized. The court had a preliminary injunction requiring the applicant to meet the purchase amount. The delayed payment proceeded to confirm this sale, in view of the provisions of OXI, R, without the judicial and unlawful court, which was invalid. r,,, & & & CP CPCP could not maintain such an order in law and the court implementing it was competent to remove the wrong, therefore, when the plea of the petitioner, although in a suicidal proceeding , Was remanded by the High Court, then the process was approved. The applicant was unaware of the legal position of the post-sale of the property that his order had suffered inherent legal weakness, which could not be endorsed by justice, justice or any law. Refused to interfere with the auction order again
