Withdrawal was justified in view of the Supreme Court decision on jurisdiction, nothing was available to show that permission to file a fresh petition was ever sought, with the order of withdrawal of any such request The promotion did not show that, before discharging, the applicant had briefly discussed the case. Possibly the first application on the merit was filed by another lawyer who had not even filed an affidavit, the applicant merely reserving the right to file a new application without reserving the right or the first application. Was withdrawn.
