Section 6 of the Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), sections 42 and 44, the petitioner of the Supreme Court of the Allotment of Land application filed a writ petition on the basis of the direction that it should issue in the land dispute. The High Court, which was in the possession of the respondents who were not paying rent, raised some doubts about the allotment and hence proceeded to dismiss the writ petition which involved controversial questions in the matter. The writ jurisdiction could not be resolved. The matter was remanded by the apex court. After resolving the allotment question, the court will decide the writ petition and inquire into it if necessary.
