MST. BILQEES KHANUM versus NATIONAL BANK OF PAKISTAN
Section 12 Limitation Act (IX of 1908), Declaration of Appeal of Sections 5 and 29 Appeal was delayed after the limitation of the Limitation Appeal Act, 1908 and the limitation Act of 1908. An application was filed under Section 5, filed for contempt of delay. The petition submitted by the respondent was that this appeal was filed under Section 12 of the Banking Companies (Loans, Progress, Credit and Finance) Act 1997, which was a special law and, therefore, the Limitation Act, 1908 The provisions of the special law were filed under the provisions of the Special Act, in which the delay under section 5 of the Limitation Act, 1908 could not be dismissed in view of the provisions of section 29 of the Special Act, 1908.
