UNITED BANK LIMITED versus MESSRS SHIFA MEDICO
Section 9 State Bank of Pakistan Circular No. 19, Dated 5 6 1997 Bank Loan Delivery During the approval of suit filed by the bank through a privileged scheme bank, the defendants, through their circular number, filed the State Bank of Pakistan. Funded under the Concession Scheme issued by. 19, dated 5 6 1997, after depositing the money by the defendants, the bank raised additional claim on the basis that during the settlement of the debt under the scheme, there was inadvertently less liability accounted for by the bank. Defendants were called upon to receive the benefit of the Incentive Scheme in response to the scheme, which the plaintiffs had agreed to pay the terms of the settlement and the performance of their portion of the settlement. Later, the bank could no longer claim. Due to their own mistake, the money was not taken by the banking court during the judgment and decree, and the High Court refused to intervene.
