HAZARA (HILL TRACT) IMPROVEMENT TRUST versus MST. QAISRA ELAHI
Article 14 Constitution of Pakistan (1973), Article 199 To publish a notice of plot sale by the Hazara Hill Track Improvement Trust Board on the payment of non-payment of building building in the sale period before the issuance of the extension order on time. Board of Trustees confirms its cancellation by the Chairman of the Trust without the approval of the Board of Trustees and to provide the applicant an opportunity to secretly hear the auction of the plot and confirmation of its sale in favor of the highest bidder. Did not decide to cancel / resume the plot at its meeting. But insisting on the collection of unused fees, it was stated that the intention of adding the applicant's plot in the auction list was with good intention as the sale process was intact and he had not approved the board chairman without the approval of the board chairman. Had paid an unused fee before such a decision. Trustees had no option to resume the plot; Chairman exercised jurisdiction without acting in office. Bed procedure condemns applicant without issuing notice to him before the plot is canceled. While the plea was based on wrongdoing, it was not specifically acknowledged, however, it was clear on the record that the Supreme Court accepted the petition's constitutional request. \ R \ n
