Since there was no date for hearing, the order to set aside the former party decree could not be retained in the eyes of the law after the petitioner had dismissed the petition when the primary order was without legal authority. The structural structure built on it collapsed. The High Court itself, on appeal, interprets the ex parte decree which means, so that the petition for leave to defend the bank and leave for a suit will be considered pending.
