NAEEM ARSHAD versus SUPERINTENDENT OF NEW CENTRAL JAIL, MULTAN
Section 397 Control of the Narcotic Material Stances Act (XXV of 1997), Section 9 (C) Constitution of Pakistan (1973), Article 199 Constitutional petition was proceeding against the accused in two cases simultaneously and the same day that both the cases were pronounced. The punishment should be treated simultaneously. The court tried two cases simultaneously, and in both cases, different cases were sentenced to death on the same day. The applicant / petitioner in his constitutional petition had sought direction for the treatment of punishment in both the cases and it was alleged that the crime was proved in the second case with his interval. After conducting the two cases together for four days, the trial court should have ordered the accused to run under Section 397, the PC High Court has accepted the petition and ordered that the accused be punished both. Sentences should run concurrently.
