FARRUKH SAYYAR KHAN versus STATE
Article 498 National Accountability Ordinance (XVIII of 1999), Section 9/10 Constitution of Pakistan (1973), Article 199 Constitutional application guarantees pre-arrest, refusal to grant security guarantees to the accused, till finalizing the constitutional petition before the concerned Division Bench. Had sufficient jurisdiction to entertain the constitutional request for bail approval for the accused under the NAB Ordinance Reference. The accused was not accused of sealing by the competent authority in question. The accused had nothing to do with the constitutional petition. A copy of the said reference was not kept on record by the NAB authorities for the arrest of the accused, no charges were made in connection with the raiding operation for his arrest at the accused's house, under the circumstances. The constitutional application was dismissed, and the pre-arrest bail was dismissed according to the suspects.
