MST. HAYAT BIBI versus NASEER-UD-DIN
Section 42 Civil Procedure Code (v. 1908), suit for annulment of section 115 amendment invalid, justification for insanity, fraud and misrepresentation before the death of the plaintiff's father, has been sold. The sale was challenged through two suits, one through a diversion and the other by a registered sale deed plaintiff, madness, duplication, forgery, misrepresentation were taken back, the positive symptoms were treatable and most of the acute illness. Patients recover and some patients with negative chronic symptoms are completely cured. The disease cannot be equated with insanity. No misreading or no evidence found. The request for review was revoked.
