SH. ASHFAQ-UR-RASOOL versus CAPITAL DEVELOPMENT AUTHORITY
Section 35 and Constitution 49 Constitution of Pakistan (1973), Decision on the application of Arts 23 and 1993 Deputy Director (Revenue) of the Capital Development Authority has asked the Sub-Registrar all types of works related to property located in the municipal boundaries of Islamabad / I have decided to register the contracts. No objection certificate (NOC) was to be issued by the office of such Deputy Director. The respondents believed that the purpose of this direction was to avoid fraudulent transactions and to protect the innocent Public Vitality Capital Development Authority and was not understood by its Deputy Director. The scheme of the Registration Act, 1908, which has the effect of hindering the registration of documents, will eventually deprive citizens of their rights under Article 23 of the Constitution.
