Applicant's position for the rehabilitation of the water course was that the civil case was finally decided by the civil court and he could not do so. Under the Validity Matter Canal and Drainage Act, 1873, which provided for appropriate relief in case of any dispute under which the order of the Court of Appeal was in accordance with the law and did not infringe the applicant's rights.
