AZHAR ABBAS versus THE STATE
Section 5 (2) of the Constitutional Code (XLV of 1860), Section 161 Constitution of Pakistan (1973), Article 185 (3), the defense witness and the Revenue Officer, clearly stated in the open meeting as a court witness that the parties considered the prices. The courts could not, in their proper context, approach the defense version, the prosecution had failed to prove the offense against the accused and the petition for leave of appeal was changed in the circumstances in which the appeal and the accused were acquitted accordingly.
