GOVERNMENT OF N.-W.F.P. versus BAKHT JAMAL
Section 29 (3) of the Specific Relief Act (I of 1877), section 42 declares for ownership of property in conflict with property for sale declarations whether it be protected forest property or privately owned property based on registered sale deed. There was also a claim that there was nothing on record since its purchase to indicate that government officials (the Department of Forestry and the Environment Department) and the plaintiffs' rights were denied by the government officials. An inquiry was made to determine, as required under sub-section (3) the Secretary to the Provincial Government of the Forestry Act, 1927, Through the Swallows and the Environment Department, the inquiry through the neutral government courts was directed to fail to define legality and said that their decisions and orders had been set aside and the case with the trial court. Has been sent to remand. The parties are directed to add further evidence in support of their claims and decide the matter after the case again.
