MUHAMMAD SHAHID FAROOQ ALIAS SHAHDA versus THE STATE
Section 426 of the Prevention Code (XLV of 1860), Sections 302/34, 109, 148 and 149 of the suspended investigating officer recovered from the possession of the accused during the inquiry that the accused was not equipped with any weapons during the incident. The case had already spent more than two years in prison, the question of sharing a common intention with the accused with his co-accused regarding his alleged liability for a crime allegedly committed by his co-accused. There were also questions that needed to be taken seriously at the trial, when the trial court suspended the prison sentence against the accused and sent him on bail. The affidavit was filed.
