Article 14 (1973), Article 185 (3) of the Constitution of Pakistan High Court's role in determining the age-and-candidate in the exercise of constitutional jurisdiction, allows the candidate to contest the Supreme Court-approved order of the High Court. Disqualifying a candidate from participating in the election The questions raised by the applicant were essentially factual questions which could be decided after recording extensive evidence and could not be done in the present proceedings. A summary of the nature of the case was observed by the court that questions could be raised in case of selection of a candidate in the election. The question will be raised in the election petition and the same will be decided by the Election Tribunal on merit after recording the evidence. The request for leave to appeal was dealt with accordingly.
