The request for a bail must be heard by a Shariah Court judge who has already dealt with the matter, after hearing section 497 of the Code of Conduct (XLV of 1860), section 302/377/34. It was not in accordance with the law to pass a non-judgmental order granted by a court to another judge and, consequently, the matter was set aside which the Supreme Court directed that he too be the same judge.
