IZZAT BAIG AWAN versus HABIB BANK LIMITED
Section 2A & 4 Constitution of Pakistan (1973), Article 212 (3) Removal of Bank Employees from Involvement in Criminal Trial In such involvement, the bank employee absorbed himself from the duty. Issued and after hearing the bank employee having the opportunity, was removed from the job, the service tribunal retained the employee's removal order that his absence was invalid, which was a legitimate absence. Whether it was credible or illegal, the sole concern of the state bank could not afford the luxury. In the absence of goodwill, the loss of goodwill proved to be a matter of relaxation by the employee and his retention in the job was not in the interest of the bank; he was rightly removed. The leave to appeal was denied.
