The constitutional plea of Article 199 alleged that the applicant of the FIR claimed that he had married a co-accused through a marriage contract, but had registered a criminal case stating that he had been co-accused by the accused. The petitioner's abduction was demanded in which he prayed for the termination of the FIR taken by the applicant. And the evidence collection, the FIR, could not, in these circumstances, be withdrawn. The applicant was directed to be involved in the investigation and the investigating officer was instructed to record the applicant's version correctly and to receive the documentary documents as well as oral evidence which the applicant intended to present.
