SAID ALIAS KHURSHID versus DEPUTY COMMISSIONER, SETTLEMENT DEPARTMENT
Controversial applicants of the Section 2 Displaced Persons (Land Settlement) Act (XLVII of 1958), Sections 9, 10 and 11 of the Constitution of Pakistan (1973), Article 199, have alleged that the petitioner allegedly used fake money. This allotment was obtained. , Fraud and forgery means no order has been passed to repeal an allotment made under a law that had no legal place in its legal jurisdiction, nor found such a place nor the Land Settlement Act. Had not obtained authority under 1958 (repealed). Empty Property and Displaced Persons (Laws) Act, 1975, and thus acting without full jurisdiction to revoke the allotment, the complete lack of jurisdiction cannot be waived nor can it Jurisdiction, which may be amended by the High Court under Article 199 unconfirmed by law. The order of the Constitution which was passed by the collector without any jurisdiction was not sustainable in the law and hence it was declared a rule.
